DivorceGoing through a divorce is a stressful time for all concerned, no matter how amicable the situation. With one in three going through the process, a good lawyer can help the process progress as smoothly as is ever possible in these circumstances. To get divorced, you have to have been married for at least a year and one of you must have lived in England or Wales for the year before the divorce. To prove irretrievable breakdown of a marriage, one of the following has to be cited – adultery, unreasonable behaviour, desertion, two-year separation with the consent of the other party (no fault) or a five-year separation with no consent needed. There are different ways of conducting the divorce but if at all possible both parties should try and stay amicable, particularly if there are children involved. Lawyers are now promoting Collaborative Divorce which means that your spouse and you agree to sit down with your respective lawyers and trash out a solution. If this doesn’t work, both law firms have to withdraw and you must find a new firm to continue the case. Mediation is also available and the courts provide a free mediation service which is worth a try. Law firms will also assist in helping you find mediators. Childrens Act
The Children Bill received Royal Assent on 15 November and is now the Children Act 2004. The Act provides a legislative spine for the wider strategy for improving children's lives. This covers the universal services which every child accesses, and more targeted services for those with additional needs. The overall aim is to encourage integrated planning, commissioning and delivery of services as well as improve multi-disciplinary working, remove duplication, increase accountability and improve the coordination of individual and joint inspections in local authorities. The legislation is enabling rather than prescriptive and provides local authorities with a considerable amount of flexibility in the way they implement its provisions. Housing & Council TaxWhat is council taxCouncil tax is a system of local taxation collected by local authorities. It is a tax on domestic property. Generally, the bigger the property is, the more tax will be charged. Some property will be exempt from council tax. Valuation bandsEach local authority keeps a list of all the domestic property in its area. This is called the valuation list.
